The WCAB panel found the petition was timely acted upon within 60 days of case transmission and that removal was not warranted because the petitioner did not show significant prejudice or irreparable harm and reconsideration would be an adequate remedy.
From the decision · page 1Defendant seeks reconsideration of the May 14, 2025 Findings of Fact and Orders (F&O) issued by the workers' compensation administrative law judge (WCJ). By the F&O, as relevant here, the WCJ found that while employed by defendant up to May 15, 2023, as a Peer Support Specialist, Occupational Group Number 212, applicant claimed injury arising out of and in the course of his employment to his eyes, mouth, respiratory system, arms, throat, lungs and head. The WCJ ordered that the parties obtain and provide further medical records to Qualified Medical Evaluator (QME) Jose Sanchez, M.D., and request a supplemental report from Dr. Sanchez.
