What the panel ordered
Defendant's Petition for Reconsideration of the April 26, 2021 Second Amended Findings of Fact, Awards and Order is DENIED, reaffirming the April 20, 2021 Opinion and Order Granting Reconsideration and Decision After Reconsideration and the April 26, 2021 Second Amended Findings of Fact, Awards and Order.
Defendant State of California, Department of Corrections and Rehabilitation filed a Petition for Reconsideration seeking review of the April 20, 2021 Opinion and Order Granting Reconsideration and Decision After Reconsideration, which had granted applicant's Petition for Reconsideration and ordered a new final award based on Dr. Bronshvag's 75% WPI rating. The WCJ then issued a Second Amended Findings of Fact, Awards and Order on April 26, 2021, finding 100% permanent disability. Defendant challenged this, but the WCAB treated the Petition as from the WCJ's final order and reviewed it.
This docket was decided more than once. Shown here is the latest released decision; we also hold April 20, 2021.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The petition was deficient in identifying grounds for reconsideration but was treated as seeking reconsideration from the WCJ's final order and reviewed on the merits, leading to denial of the petition.
